maybe this makes it clearer, just a leeetle bit, the bloomberg article says

The administration asked the high court to intervene after a federal appeals court questioned the government's handling of the case and blocked Padilla's transfer to Miami to face criminal charges. ... (and) said the administration's handling of the case left ``an appearance that the government may be attempting to avoid consideration of our decision by the Supreme Court.
