I'm confused by the EFF story. It says "The EFF's ongoing case may be bogged down by constitutional questions due to new FISA provisions, but they won't impact the new case". What ongoing case? What new case? The story only mentions one case, which I guess you could say is ongoing now and is obviously a new case so it's not clear what this line is referring to.
