Rationale For Fair Use: The inherent copyright holder has freely distributed the photo to media outlets with the express intent of having it freely published without need for recompense, and has shown no interest in proprietary rights. The image is of low-resolution and greatly expands reader knowledge of the relevant article. It fits all definitions of a "publicity photo" given the circumstances and environment in which it was created and distributed.

Disputed: AP claims it is their photograph.[1] Did a Taliban member take the photo, or did the Taliban pose for an AP photographer? Where did you acquire the image?

AP claims all photos as "theirs", including ones distributed by the DoD and similarly public domain sources; they charge a fee for "finding" the image in those cases, not for any legitimate copyright concerns. "Suggesting" a relevant image and such -- any and all photos say "AP photo". Since the articles say that the Taliban photographed themselves with the vehicles, I would assume that is exactly what happened. You'll find AFP also claiming the photos, as well as Voice of America, etc. They were distributed to all major media outlets

Although the AFP outlets I looked at ran a different photo, your assumption seems likely. However, is there a possibility that a freelance journalist made and sold the images to agencies on commercial terms? --InfantGorilla (talk)
