Description

Photo by w:User:Adam Carr. From Wikipedia image w:Image:PICT4336.JPG. The depicted object, however, is the front page from October 1, 1946 of a still existing German newspaper. The text (which is quite easily readable) was obviously written by someone who died after that date. The author of that text holds or held the copyrights on the text; the newspaper acquired the right to publish it. That copyright would still be valid in Germany (until 70 years after the death of the author); it would thus also still be valid in other signatory countries of the Berne Convention—e.g. in the U.S. until 95 years after the publication. The provenance of the images is unknown. It is also unknown whether the layout of the front page itself could have been copyrighted; this seems doubtful. As an image of a copyrighted object, it can be used only under a "fair use" provision, even if the creator of the image released that image itself into the public domain.
