They should sue for Iraq and Afghanistan too

Congress has NOT made a formal declaration of war since 1942 in World War II, the last country of that war, against Romania. This lawsuit will fail because Congress already technically agreed to the measure by having a seat on the United Nations Security council, which is funded by the US congress. From Wikipedia: "In many instances, the United States has engaged in extended military engagements that were authorized by United Nations Security Council Resolutions and funded by appropriations from Congress." The US voted along with the majority of the Security Council to allow NATO intervention. See Wikipedia: Declaration of war by the United States. 2011 Military Intervention in Libya also known as Operation Odyssey Dawn. No one nation voted against the operation. They did however abstain. This is just another ploy to rob taxpayers of their money. It is because of wasteful spending like this that the important things in this country cannot be funded or taken care of. It is because of politicians and their lies, cheating, and stealing, that this country, and the world are going to shit, and no one can stop it.

Judicial activism

I wonder how activist the judge considering this case will be, since the courts historically have been reluctant to interfere with executive privilege. If the judiciary gets involved, then essentially all three branches of government will be fighting over war powers.

A judge is not "activist" simply because he disagrees with your interpretation of the law.

Not necessarily true. I believe that the President should have sought congressional approval for the Libya mission, but at the same time believe that the courts should not get involved.
